Domestic Relations Law Section 170 in New York provides for both fault-based and no-fault grounds for divorce. An irretrievable breakup of the marriage for a minimum of six months is the no-fault basis. Cruel and inhumane treatment, one year of abandonment, adultery, three years of incarceration, and separation (one year by consent or court order) are examples of fault-based grounds. Because no-fault divorce is so easy, most people choose it.
